Fishman Haygood Partner Lance McCardle was a presenter at the 2015 PIABA Annual Meeting held October 20-24, 2015 in Jacksonville, Florida.
Lance was a panelist for a program titled “Direct Participation Programs – Non-traded REITs, TICs, BDCs, Oil & Gas, Equipment Leasing and Managed Futures: Are These DPPs Suitable for Anyone?” The panel discussed the offer and sale of DPPs such as Oil & Gas Limited Partnerships, Tenant in Commons (“TICs”) Business Development Companies (“BDCs”) and Non-Traded Real Estate Investment Trusts (“REITs”) to public customers.
The panel focused on the inherent flaws and risks associated with these programs, which are often non-publically traded, including lack of adequate disclosures to potential customers. Lance, who has represented many investors in FINRA arbitrations involving DPPs, gave attendees practical tips for moving forward with claims against broker-dealers and investment firms relating to these alternative investments.
